1. Who we are

Piercing Studio (the "Service") is provided by Don Piercing ("we", "us", "our"). By using the Service you are entering into an agreement with Don Piercing.

2. Acceptance of terms

By accessing, browsing, or using the Service you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service. Your continued use constitutes ongoing acceptance.

3. Description of service

Piercing Studio provides tools for piercing studios to manage a jewelry catalog, simulate piercings on a sample ear or a customer's photo, and preview anodizing colors.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• Use the Service for any unlawful purpose or in breach of any applicable law.
• Engage in fraud, spam, or impersonation.
• Infringe any intellectual property, privacy, or other rights of any third party.
• Upload malware, attempt to probe, scan, or test the vulnerability of the Service, or interfere with its security.
• Scrape, crawl, or harvest data from the Service except as expressly permitted.

5. Account credentials

You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

6. Intellectual property

The Service, including all software, designs, text, graphics, and branding, is owned by Don Piercing and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within your selected plan. You may not reverse engineer, resell, redistribute, or circumvent any technical limits of the Service.

7. User content

You retain ownership of photos and content you upload. You grant us a limited, worldwide license to host, store, and process that content solely to provide the Service to you.

8. Service level

We provide the Service on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that defects will be corrected. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Payment, billing and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, taxes, renewals, cancellations, and refund mechanics, please refer to the Paddle Checkout Buyer Terms.

Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time; access continues until the end of the period you have paid for.

10. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service ends immediately. You may export your data for a reasonable period after termination before it is deleted.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability for any claims arising out of or relating to the Service is limited to the amounts you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

12. Indemnity

You agree to indemnify and hold us harmless from any claims arising out of your user content, your unlawful use of the Service, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws applicable at our place of business. Any dispute will be resolved in the courts of that jurisdiction, unless a mandatory consumer law in your country of residence provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
